    • Prop 8 supporters seek full review

      Yesterday was the deadline for supporters of California’s Proposition 8 to request another appeal on the measure’s unconstitutional ruling, and so proponents of the law are seeking a full review by the Ninth Circuit Court of Appeals.

      For those who haven’t quite followed this mess of a case, Prop 8 was ruled unconstitutional in 2010 by Judge Vaughn Walker, and a three-judge panel upheld that ruling two weeks ago. ProtectMarriage, a pro-Prop 8 group, now seeks an en banc review of the case, namely more people from the Ninth Court reviewing it. Judgement call from the Advocate:

      The en banc request will likely keep the case out of the Supreme Court until the 2012 presidential election. It’s not exactly clear how this will effect marriage equality resuming in California, but the stay on marriages will likely continue until the Ninth Circuit decides whether to review the three judge decision.

      Why is this debate not over yet? Prop 8 will continue to be ruled unconstitutional because it is unconstitutional. This hurtful measure needs to be destroyed once and for all.
